Welcome to Calm Waters Plumbing. These Terms and Conditions ("Terms") govern your use of this website and your engagement of plumbing services from Calm Waters Plumbing ("Calm Waters Plumbing," "we," "us," or "our"). By using this site or requesting service, you agree to these Terms. If you do not agree, please do not use this site.

2. Service Area

We provide service to residential customers located within approximately a 45-minute drive of our home base in the greater Twin Cities metro area. Service availability outside that radius is at our discretion. We may decline or refer any request that falls outside our service area or scope.

3. Scope of Services

We provide residential plumbing services only. We do not provide commercial plumbing services, and we do not provide drain cleaning services. Requests outside our scope will be declined or referred elsewhere.

Nothing on this website constitutes an offer to perform work. A service relationship begins only when we confirm an appointment and, where applicable, you accept a written estimate.

4. Estimates, Quotes, and Pricing

This website does not list pricing. Any figure discussed by phone, text, or email before we have seen the work is a rough range only and is not binding.

  • Written estimates are valid for 30 days from the date issued.

  • Estimates are based on visible and disclosed conditions. Concealed conditions — including but not limited to inaccessible piping, prior non-code work, corrosion, water damage, or hidden structural or material conditions — may change the scope and cost of the work.

  • If additional work is required, we will inform you and obtain your approval before proceeding.

  • Diagnostic or trip charges, where applicable, are disclosed before we schedule.

5. Scheduling, Access, and Cancellation

You agree to provide safe, lawful, and reasonable access to the work area at the scheduled time, including access to shutoffs, water heaters, fixtures, and any relevant equipment.

  • Please provide at least 24 hours' notice to cancel or reschedule.

  • If we arrive as scheduled and cannot gain access to the property or work area, a trip charge may apply.

  • We may reschedule for weather, emergencies, supply availability, or safety conditions.

6. Payment

Payment is due upon completion of the work, unless we have agreed to different terms in writing. We accept cash, check, and major credit cards. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by Minnesota law, together with reasonable costs of collection.

7. Warranties

Workmanship. We warrant our labor for one to two years, depending on the work performed, as stated in your estimate from the date of completion. If our work fails during that period due to our workmanship, we will correct it at no labor charge to you.

Materials and equipment. Materials, fixtures, and equipment carry only the warranty offered by their manufacturer. We pass through manufacturer warranties to you but do not extend, enlarge, or independently guarantee them.

Exclusions. Our warranty does not cover: normal wear; damage from misuse, neglect, freezing, water quality, or acts of nature; work altered or repaired by others; pre-existing conditions we did not install; or components you supplied.

Water heaters. Water heater warranty terms, registration requirements, and coverage periods are set by the manufacturer. Some manufacturer warranties require professional installation and timely registration to remain valid.

8. Customer Responsibilities

You agree to:

  • Disclose known conditions, prior repairs, and any relevant history of the plumbing system.

  • Identify the location of shutoffs and any concealed lines, wiring, or systems in the work area if known.

  • Secure pets and remove valuables, breakables, and obstructions from the work area.

  • Obtain any homeowners association or landlord approval required for the work.

  • Notify us if you are not the owner of the property or are not authorized to approve the work.

9. Permits and Code

Where a permit is required, we will identify it and address permitting as agreed in your estimate. Work is performed to applicable Minnesota Plumbing Code and local requirements in effect at the time of the work. We are not responsible for bringing unrelated pre-existing conditions into compliance unless that work is specifically included in your estimate.

10. Emergency and Urgent Service

Any reference on this site to emergency or urgent service does not create a guaranteed response time. If you have an active leak, flooding, gas odor, or any condition that threatens safety, shut off the supply if you can do so safely and call 763-312-3454. If you smell gas or suspect a gas leak, leave the building and call 911 and your gas utility first.

11. Website Content

The content on this site is provided for general information only. It is not a substitute for a professional evaluation of your specific plumbing system, and you should not rely on it to diagnose, repair, or make decisions about your property. To the fullest extent permitted by Minnesota law, our total aggregate liability arising from or related to any service will not exceed the amount you actually paid us for that service.

Nothing in these Terms limits liability that cannot be limited under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Calm Waters Plumbing and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of this site, your failure to disclose known conditions, or your violation of any law or third-party right.

18. Communications Consent

When you submit your phone number through this site or provide it to us directly, you consent to receive calls and text messages from us regarding your service request, appointment, estimate, and work in progress. Message and data rates may apply. Message frequency varies. Reply STOP to opt out of texts; reply HELP for help. Opting out of texts does not prevent us from contacting you by phone or email about active work.

Consent to receive service-related messages is not a condition of purchase.

19. Reviews and Testimonials

Any reviews, ratings, or testimonials displayed on this site reflect the experience of specific customers at a specific time. Individual results vary and are not a guarantee of the outcome of your project.

20. Changes to These Terms

We may update these Terms at any time. Changes take effect when posted to this page, and the Effective Date above will be updated. Your continued use of the site after changes are posted means you accept the revised Terms. The Terms in effect on the date of your estimate govern that work.

21. Governing Law and Venue

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or our services will be brought exclusively in the state or federal courts located in Sherburne County, Minnesota, and you consent to the jurisdiction of those courts.

22. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force. These Terms, together with your written estimate and our Privacy Policy, constitute the entire agreement between you and us regarding this website and our services.
